The Ninth Circuit refused Thursday to revive Yahoo Inc. investors' derivative shareholder suit alleging the company violated a deal with the U.S. Securities and Exchange Commission by purchasing stock in retail website Alibaba, saying the claims have no place in federal court.

Yahoo investors urged the Ninth Circuit on Wednesday to revive their derivative shareholder suit alleging Yahoo Inc. violated a deal with the U.S. Securities and Exchange Commission by purchasing Alibaba stock, saying merely complaining to the SEC instead of suing wouldn't work because "writing letters" doesn't get a response.

Fund Wants Suit Over Yahoo's Alibaba Investment Revived
A pension fund on Friday appealed a California federal judge's second dismissal of a shareholder derivative suit alleging that Yahoo Inc. failed to register as an investment company once its Alibaba Group Holding Ltd. stake outweighed its internet business, contending the court erred in viewing the fund as a private litigant.
