Liquor Chain's Bid For Hack Coverage Revived By 5th Circ.
The Fifth Circuit on Monday revived Spec's Family Partners Ltd.'s bid to force Hanover Insurance Co. to cover costs the liquor store chain has incurred in a lawsuit against its credit card processor after a data breach, saying a lower court improperly found that an exclusion for contract-based claims bars coverage.

Hanover Insurance Co. on Thursday asked the Fifth Circuit to find it does not owe a Texas liquor store chain the costs of a lawsuit against the chain's credit card processor after two data breaches, arguing all the evidence pointed toward the claim being excluded.

Liquor Chain Wants 5th Circ. To Revive Hack Coverage Suit
A Texas liquor store chain urged the Fifth Circuit on Friday to reverse the lower court ruling that found Hanover Insurance was not obligated to pay the costs of a lawsuit seeking recovery of $4 million charged by the chain's credit card processor following two data breaches, arguing the policy exclusions were wrongly interpreted.
