A Florida federal judge tossed EEOC claims that a Massage Envy franchise owner illegally fired an employee with plans to visit Ghana on fears she would return with the Ebola virus, finding Thursday she did not qualify as disabled under the Americans with Disabilities Act.

A Massage Envy franchise operator broke the law when it fired an employee who planned to travel to Ghana over fears that she would carry the Ebola virus upon her return to the United States, the U.S. Equal Employment Opportunity Commission said in a lawsuit filed on Wednesday in Florida federal court.
