A Spanish supplier to Trader Joe's Co. urged a federal judge on Wednesday to dismiss it from a false-labeling suit claiming it provided the "truffle aroma" used in the grocer's truffle-flavored olive oil that allegedly contains "no black truffle whatsoever," saying it has no New York presence and can't be included in the suit.

Trader Joe's Co. has asked a New York federal court to impose sanctions on shoppers who filed a proposed class action accusing the grocery store of charging premium prices on truffle-flavored olive oil containing no black truffle, claiming Friday that the shoppers lied about whether DNA tests proved the lack of truffles.

Trader Joe's Co. and olive oil company Monini North America Inc. were each hit with proposed class action lawsuits on Tuesday in New York federal court alleging that their "truffle oil" products are flavored with "an industrially produced, chemically derived perfume known as 2,4-dithiapentane" rather than actual truffles.
