Aetna on Monday defeated a bid to include all of its policyholders in a putative class alleging it violated the Employee Retirement Income Security Act by denying plan participants coverage for medically necessary psychiatric treatment through a "hidden" exclusion.

Marsh & McLennan Companies Inc. was slapped Monday with a putative class action accusing it of violating the Employee Retirement Income Security Act because it denied medically necessary psychiatric treatment coverage to a benefits plan beneficiary by way of an allegedly hidden exclusion.
