An Illinois federal judge ruled Wednesday that a mental health care provider will have to face a suit by Philadelphia Indemnity Insurance Co. alleging it should not have to defend the provider in an underlying suit over a patient's suicide.

Insurer Can't Nix Coverage After Defending Suit, Court Told
Health provider Behavioral Health Alternatives Inc. asked an Illinois federal judge Wednesday to dismiss a suit by its insurer over coverage related to the suicide of a BHA client, saying the insurer delayed unconscionably in expressing its concerns and allowed BHA to rely on defense it thought was being provided without caveats.
