A federal judge in Texas certified a class of more than 200,000 health and retirement plan participants who were allegedly charged excessive fees by Fringe Benefit Group, giving the lawsuit class status again two years after the Fifth Circuit tossed the first class certification for being hastily prepared.

A group of participants in employee benefit plans offered by the Fringe Benefit Group can move forward as a class of about 90,000 members in their suit alleging the company flouted the Employee Retirement Income Security by charging excessive fees, a Texas federal judge ruled.
