A would-be T-Mobile customer announced Monday that he struck a deal with the carrier to wrap up his proposed class suit alleging T-Mobile used the information he gave when price shopping to open up an unauthorized account in his name and bill him for services he didn't use.

T-Mobile has succeeded in further shaving down a proposed class action accusing the company of using personal information to open an unauthorized account, but the would-be customer will get a third whack at re-filing the suit due to the "liberal amendment policy" found in federal law, a California federal judge said.

A California federal judge refused to release T-Mobile from a putative class action accusing it of using personal information solicited from potential customers to open unauthorized service accounts, finding that the plaintiff's allegations that he had been deceived and had suffered economic injury were enough to sustain two of his five claims.
