ACH Food Batters Suit Over Half-Full Baking Mixes, For Now
A California federal judge dismissed a proposed class action alleging ACH Food Companies Inc. purposefully packages baking mixes in half-full opaque boxes to mislead consumers, saying that the suit failed to “allege facts to support the conclusion that the slack fill is nonfunctional.”

ACH Food Companies Inc. asked a California federal court Thursday to dismiss a proposed consumer class action alleging the manufacturer purposefully packages baking mix in opaque boxes that are only half full, arguing that "slack fill" ensures packages are properly sealed and that state law permits the practice.
