A California federal judge has ordered the father-son leadership team of Monex Deposit Co. to pay $33 million in restitution and a civil monetary penalty of $5 million to end the Commodity Futures Trading Commission's $290 million fraud case alleging the metals brokerage ripped off mom-and-pop investors.

CFTC Loses Calif. Suit Against Monex Metals Broker
A California federal judge on Tuesday completely rejected the Commodity Futures Trading Commission's claims that the metal brokerage firm Monex executed thousands of illegal, off-exchange leveraged precious metals transactions and fleeced customers out of $290 million, ruling Monex's trading fell outside the agency's authority.
