A jury must consider whether Evanston Insurance has to defend a sperm bank in litigation over a police officer's death related to a liquid nitrogen leak, a Georgia federal judge ruled Wednesday, saying pollution and hazardous materials exclusions in the insurer's policy don't clearly bar coverage.

Evanston Insurance Co. on Wednesday asked a Georgia federal court to declare it does not have to cover a tissue bank for the death of a police officer in an incident involving a liquid nitrogen leak, saying the leak falls under the policy's pollution exclusion.
