Colombian softgel manufacturer Procaps SA pressed a New York federal court Tuesday to nix part of an arbitral award rejecting its $135 million claim for lost profits after Patheon Inc. breached their product development deal, arguing that the arbitrators exceeded their authority by depriving Procaps of this contractual remedy.

Pharmaceutical company Patheon Inc. has urged a New York federal judge to deny softgel maker Procaps SA's request to vacate part of an arbitration award finding it can't recover $135 million in lost profits damages for a nixed product development agreement, telling the court the agreement doesn't allow for such damages.
