A North Carolina bar called The Bathtub Gin urged a New York federal court Monday to toss a trademark suit brought by the company behind a Manhattan lounge called Bathtub Gin, contending the self-proclaimed "posh" establishment hasn't proved its asserted mark was infringed or that the businesses will likely be confused.
