An Illinois federal judge has dismissed a suit claiming Best Buy's "Geek Squad Protection Plan" doesn't deliver as a warranty, ruling the plan does not fit the Magnuson-Moss Warranty Act's definition of a warranty and thus doesn't fall under the statute.

Samsung asked an Illinois federal judge Tuesday to let it out of a lawsuit accusing it and Best Buy of knowingly selling faulty plasma televisions under an improperly marketed warranty, saying the suit raises time-barred claims that are too vague to proceed.

A pair of consumers slapped Samsung and Best Buy with a proposed class action in Illinois federal court Friday, alleging the companies sold plasma televisions they knew would fail early and that the retailer improperly marketed its insufficient Geek Squad Protection Plan as a warranty.
