A former Macy's employee on Monday urged a Pennsylvania federal judge not to toss her proposed class action accusing Cigna and American Specialty Health of wrongly shifting administrative costs to plan participants, arguing that she made plausible allegations under the Employee Retirement Income Security Act.

Cigna and American Specialty Health have been hit with a proposed ERISA class action in Pennsylvania federal court accusing them of colluding to saddle members and plans with the charges ASH incurs for processing claims and administering a network on Cigna's behalf.
