A defunct diagnostics lab's bankruptcy trustee told an Alabama federal judge Wednesday that he's appealing to the Eleventh Circuit Mintz's win in a malpractice case alleging the law firm failed to advise the cholesterol testing company that its business practices could run afoul of federal law.

An Alabama federal judge Tuesday found Mintz provided a now-bankrupt diagnostic lab sufficient warning in 2011 that its business practices could run afoul of federal law, saying an exact risk assessment was unnecessary.

A shuttered diagnostics lab hit back against Mintz Levin Cohn Ferris Glovsky & Popeo PC's bid for a win in a malpractice suit, saying the firm was over-relying on a deposition from the bankruptcy trustee for the diagnostics lab in saying the lab wasn't hurt by the firm's advice regarding its business practices.
