A Massachusetts federal judge has thrown out a construction company's breach of contract claim against an engineering consultant over allegedly shoddy work on projects in El Salvador, saying it is trying to benefit from a contract to which it is not a party.

A Salvadoran construction company cannot be awarded damages because a Boston-based engineering consultant allegedly breached its contract with the U.S. government on a relief project in the Central American nation, costing the builder nearly $9 million, the consultant told a federal judge Thursday.
