A company accused of infringing a rival's patent for a fracking tool was victorious Friday in its counterclaims after a Texas federal judge entered final judgment of nearly $40 million in damages, saying the rival "acted with wanton and malicious intent."

An owner of Repeat Precision LLC told a Texas federal court Monday it should toss fracking supplier Diamondback Industries Inc.'s claims that his attempt to acquire the company was just a ploy to access and exploit Diamondback's confidential information, saying the accusations are "threadbare."

Diamondback Industries Inc., which provides drilling and fracking equipment for energy companies, has filed a federal lawsuit in Texas alleging that it was the victim of a ruse by another company that feigned interest in purchasing it as a means to gain access to and exploit Diamondback's confidential information.
