Food retailer Topco Associates LLC won the dismissal of a proposed class action over its vanilla almond milk product after a New York federal judge found that the company did not put incorrect information on the product's vanilla flavor label.

An almond milk manufacturer has said there is no way a reasonable consumer would have been tricked into thinking its product labeled as "vanilla" is flavored entirely by those beans because the ingredient list on the back of the box itself indicates otherwise.
