Sports trading card company Panini America Inc. told a California federal court that rival Upper Deck can't bring trademark claims over two cards showing supposed license partner Michael Jordan in the background, calling his appearance in the photographs "indiscernible and incidental."

Sports trading card company Upper Deck is suing rival Panini America Inc. for releasing cards that feature Michael Jordan in the background, claiming Panini's "nefarious misconduct" blatantly violates Jordan's trademarks and Upper Deck's exclusive licensing deal with the basketball superstar.
