XL Specialty Insurance Co. cannot void an aviation liability policy issued to a charter plane operator, passengers injured in a plane crash told a Florida federal court, saying the insurer has not proved that the operator made fraudulent or material misrepresentations in its application for insurance.

An aviation and hull liability policy issued to a Florida charter plane operator months before a fatal plane crash must be voided because the operator used fraudulent and falsified information in its policy application, XL Specialty Insurance Co. told a Florida federal court.
