A New York federal judge on Friday tossed a reworked version of a proposed consumer class action claiming a Wegmans-brand vanilla cake mix is falsely labeled as "naturally flavored," saying the suit doesn't plausibly allege that the product contains an artificial vanilla substitute.

A New York federal judge has tossed with leave to amend a proposed class action claiming a Wegmans vanilla cake mix is misleadingly labeled, but said he was "skeptical" the plaintiffs could successfully allege that consumers believe the mix is predominately flavored from vanilla extract.

Supermarket chain Wegmans Food Markets Inc. was hit on Thursday with a proposed class action alleging that its brand vanilla cake mixes are misleadingly labeled and have less vanilla than the labels claim.
