After being denied multiple bids to have a federal court hear a Pittsburgh restaurant's lawsuit seeking insurance coverage for COVID-19 closures, Motorists Mutual Insurance Co. will ask the Third Circuit to decide if the case belongs before a state judge or a federal one.

A Pennsylvania federal judge Thursday once again sent a Pittsburgh restaurant's pandemic coverage suit back to state court, re-stressing her position from three months ago that there aren't enough state court rulings on COVID-19 coverage that the federal court can rely on.

Motorists Mutual Insurance Co. is looking to send a restaurant's coverage suit back to Pennsylvania federal court, saying there is complete diversity between the parties and the amount the restaurant is seeking for alleged losses stemming from the COVID-19 pandemic is more than $75,000.
