A federal judge has ordered a Houston-area man and his company to pay the FTC nearly $37.6 million, writing that he "took advantage of consumers' desperation" during the COVID-19 pandemic and "consistently misled" customers about his ability to deliver personal protective equipment.

A Houston federal judge is deciding whether a Texas merchandise company should be permanently enjoined from selling COVID-19 personal protective equipment in addition to a judgment as high as $37.5 million, with counsel for the Federal Trade Commission telling the court that without an injunction, there is nothing stopping the company from taking advantage of its future customers.

A Texas merchandise company took advantage of increased demand for personal protective equipment during the coronavirus pandemic's first months and sold purportedly in-stock face masks, thermometers and more — offering guaranteed delivery dates at an extra cost — and then never delivered or underdelivered the products, the FTC said Tuesday.
