A Liberty Mutual unit shouldn't have to defend officials of a defunct Medicare Advantage insurer over a health care provider's $20.5 million in outstanding bills, a New York federal magistrate judge recommended, finding that the underlying suit relates to an earlier claim.

A Liberty Mutual unit told a New York federal court Thursday that it should have no duty to defend officials of Quality Health Plans of New York Inc., a now-defunct Medicare Advantage insurer accused of failing to pay a health care provider back roughly $20.5 million in outstanding bills.
