A personal injury attorney cannot get a nearly $124,000 federal tax refund for his claims that he was improperly taxed on settlement awards because he failed to first seek the funds on amended tax returns, a California federal court said.

The Internal Revenue Service wrongly taxed the full value of settlement awards won by an injury attorney even though he received only a third of the proceeds, he told a California federal court, seeking a nearly $124,000 tax refund.
