The U.S. Department of Transportation has pushed back on claims it violated the law by ignoring obligations to consider how a program to expand waterways for commercial transportation would impact endangered species, arguing no such requirement exists.

The U.S. Department of Transportation Maritime Administration's program to expand the use of U.S. waterways for commercial transportation has not undergone the required review to make sure it won't jeopardize endangered species, a green group said in a lawsuit filed Tuesday.
