A renewable energy company told a New York federal court that its pollution insurer must cover cleanup costs for a Rhode Island property that the company intended to redevelop, saying its policy provides coverage for costs stemming from a pollution incident discovered during the policy period.

Nautilus Insurance wants out of its pollution policy with Revity Energy because the company switched its intended use of a construction site from building a "solar farm" to a residential development project, which should bar coverage under the policy's "material change in use exclusion," the insurer told a New York federal court Wednesday.
