An insurance company that says it was left on the hook for a construction contractor's multimillion-dollar debts can move forward with most of its claims against a bank that allegedly swept $1.5 million from the contractor's account to settle a separate beef, a Florida federal judge has ruled.

FineMark National Bank & Trust cannot escape an insurer's suit accusing the bank of improperly sweeping $1.5 million out of a construction company's account, a Florida federal court ruled Tuesday, saying it would not settle disputed facts at this stage of the proceedings.

United States Fire Insurance Co. took FineMark National Bank & Trust to Florida federal court Monday, claiming the bank improperly swept funds out of a policyholder's account, which forced the insurer to face more than $10 million worth of claims from subcontractors.
