Grubhub Drivers Can't Ax Arbitration After Postmates Ruling
Grubhub's delivery drivers cannot avoid arbitration in an employee status case because they are not engaged in interstate commerce transportation work, the First Circuit ruled, applying the same logic from a similar case involving Postmates Inc. delivery service from a week earlier.

1st Circ. Wary Of Reviving Postmates, Grubhub Driver Suit
A First Circuit panel on Wednesday was hesitant to accept arguments that Postmates and Grubhub delivery drivers are engaged in interstate commerce and exempted from arbitration simply because they pick up items that were delivered to a store from out of state and take them to their final customers.
