Two developers of the mRNA delivery system used in Pfizer and BioNTech's COVID-19 vaccine have urged a New York federal judge to toss a suit from Acuitas Therapeutics Inc. seeking a declaration that the sale of Pfizer's COVID-19 Comirnaty vaccine does not infringe nine of the developers' patents.

A pharmaceutical company that says it developed the mRNA delivery system it licenses to Pfizer and BioNTech for use in their COVID-19 vaccine asked a New York federal judge to strike down nine patents owned by two rival mRNA developers and declare they aren't infringed by Pfizer's Comirnaty vaccine.
