A glass container manufacturer will pay $5 million to resolve a proposed class action alleging it loaded its employee retirement plan with costly and underperforming investment options managed by a formerly affiliated company, according to a filing in Ohio federal court.

An Ohio federal judge denied a Toledo-based glass container manufacturer's bid to throw out a proposed class action accusing it of mishandling its workers' 401(k) plan, ruling the former worker who brought the suit has plausibly alleged the company "selected an imprudent investment lineup from the outset."
