A Vermont federal judge rejected an elder care facility's bid to toss a U.S. Equal Employment Opportunity Commission suit alleging it failed to stop residents' racist behavior toward Black workers, ruling the business can't sink the suit by claiming its clients' outbursts are beyond its control.

A long-term care facility failed to intervene when Black employees repeatedly complained that residents called them racial slurs and subjected them to race-based assaults, according to a lawsuit the U.S. Equal Employment Opportunity Commission filed Tuesday against the company in Vermont federal court.
