Trader Joe's Scores Win In Chocolate Heavy Metals Case
Consumers alleging dark chocolate sold by Trader Joe's contains unsafe levels of lead and cadmium cannot pursue some of their state law claims because information about the presence of heavy metals in chocolate has been reasonably available to consumers for decades, a California federal judge ruled.

A California judge has dismissed five out of nine claims in a consolidated complaint alleging that Trader Joe's Co. misled consumers by failing to disclose that its dark chocolate bars contain heavy metals, finding that the complaint doesn't do enough to allege that the amounts are actually dangerous.

Trader Joe's on Monday urged a California federal court to toss a consolidated false advertising class action alleging the grocer's chocolate contains unsafe levels of lead and cadmium, saying it had no duty to disclose the metals as they fall well within the regulatory threshold for safe consumption.
