An Illinois federal judge essentially halved on Friday two consumers' false advertising suit targeting artificial sweeteners allegedly found in Coca-Cola's Fresca soda water, cutting one plaintiff and one focus of their consumer fraud claims from the case.

A proposed class of consumers urged an Illinois federal judge to keep intact their false ad suit against Coca-Cola over artificial sweeteners in its Fresca soda water, saying the company's arguments seeking to ax their claims are unsupported by the U.S. Food and Drug Administration's own statements and federal requirements and simply fall flat.

Coca-Cola is asking an Illinois federal judge to throw out a proposed class action alleging it misleads consumers into thinking its Fresca brand of soda water contains real fruit with no added sweeteners, saying the imagery on its cans complies with federal regulations and an artificial sweetener is properly labeled.

Consumers hit the Coca-Cola Company with a putative class action Monday alleging the beverage giant misleads customers into believing there are no added sweeteners in its Fresca grapefruit and black cherry beverages by labeling them "Sparkling Soda Water" even though they contain the artificial sweetener aspartame and the additive citric acid.
