A Texas federal judge has stopped short of dismissing a lawsuit accusing the Public Company Accounting Oversight Board of operating unconstitutionally, instead sending the case to Washington, D.C., for further proceedings because the case has little to do with the Lone Star State.

The Public Company Accounting Oversight Board asked a Texas federal judge to throw out a lawsuit brought by an auditor who claims he is facing an unconstitutional disciplinary proceeding before the board, despite a Friday U.S. Supreme Court ruling addressing a similar challenge at the U.S. Securities and Exchange Commission.

The Public Company Accounting Oversight Board has become the latest regulator to face a legal challenge from a conservative group looking to curtail the powers of the administrative state, with a lawsuit filed in Texas federal court Thursday evening arguing that the board's in-house disciplinary process violated an auditor's rights to a fair trial.
