A California federal judge on Wednesday agreed to ship back to state court allegations that CVS Caremark and Express Scripts conspired to hike insulin drug prices, finding that the state of California's claims do not relate to the companies' work with the federal government.

Counsel for California urged a federal judge Wednesday to send allegations that CVS Caremark and Express Scripts conspired to inflate insulin drug prices back to state court, arguing the pharmacy benefit managers can't fight the claims in federal court because the challenged conduct doesn't relate to insurance plans contracted with the federal government.
