A bakery's counterclaims were kept alive in an insurer's coverage fight over a driver's bodily injury suit, with a California federal judge finding Monday that the bakery could be found vicariously liable for conduct by a logistics company that is the named insured of the policy at issue.

Coverage isn't available to a logistics company in a lawsuit alleging that a driver was injured when a pallet of cargo for a bakery fell on him, an insurer told a California federal court, saying the policy excludes bodily injury coverage for employees of the insured.
