A Florida federal judge on Wednesday allowed First Amendment claims to proceed in a challenge by Penguin Random House and others over a school board's decision to ban from school libraries certain books that are about or authored by people of color or the LGBTQ+ community, but tossed a Fourteenth Amendment equal protection claim.

Penguin Random House LLC filed a federal lawsuit on Wednesday challenging a Florida school district's decision to ban books from its school libraries that deal with racial discrimination or LGBTQ+ issues, joining forces with free expression nonprofit PEN America, authors and parents to demand that the books be put back on the shelves.
