The insurer Continental Casualty Co. defended its federal suit in Indiana seeking to avoid coverage of law firm Cantor Colburn LLP in an arbitration with its clients, arguing in response to a motion to dismiss the suit that the controversy is ripe.

Accusing Cantor Colburn LLP of "intentional wrongdoing" invalidating its malpractice insurance policy, Illinois insurer Continental Casualty Co. has gone to Indiana federal court seeking declaratory judgment to duck coverage of the firm in an underlying suit over an allegedly botched patent application for a corn oil separator.
