The U.S. Department of Education and Texas have asked a Texas federal judge to stay a case involving a challenge to the agency's new policy enforcing protections for transgender students in Lone Star State schools while the issue gets worked out at the Fifth Circuit in a Thursday motion.

Two Texas federal judges have blocked the U.S. Department of Education from enforcing protections for transgender students in Lone Star State schools while lawsuits against the rules are litigated, with one judge saying the measures provide "extra privileges to the transgender student based on subjective feelings of discomfort."

Texas AG Says Title IX Gender Rule Creates 'No-Win Situation'
Texas Attorney General Ken Paxton hit the Biden administration with a lawsuit over its Title IX expansion, writing in a federal court complaint that inclusion of gender identity and sexual orientation in the definition of sex discrimination puts Lone Star State schools "in a no-win situation."
