Settling accusations of procedural "gamesmanship," a federal judge has approved an agreement to return to Connecticut state court a lawsuit against the Stew Leonard's grocery store chain by the estate of an Ailey School-trained ballet dancer who allegedly died from eating mislabeled peanut-laden cookies manufactured by another company.

Grocery chain Stew Leonard's told a Connecticut federal judge on Tuesday that there is "not a potentially plausible claim" against the eight of its individual employees named in a lawsuit brought by the family of a consumer who died after eating a cookie she bought that had not been labeled as containing peanuts.

The family of a U.K.-born dancer is suing the Stew Leonard's grocery store chain, alleging its failure to update labels of cookies that contained peanuts led to her death at age 25 from an allergic reaction.
