The Ninth Circuit on Thursday ordered an importer's Akin Gump Strauss Hauer & Feld LLP attorneys to pay a European winemaker fees for having to defend against the importer's "spurious objections" to the winemaker's valid arbitral award, ruling that the importer's "self-indulgent" appeal warrants sanctions in the form of fees.

A European winemaker slammed attempts by a U.S. importer and its Akin Gump Strauss Hauer & Feld LLP attorneys to "recast a frivolous appeal as a good-faith effort," saying they should have to pay monetary sanctions for pursuing what the Ninth Circuit called a "self-indulgent" appeal of a valid arbitration award.

The Italian maker of Kris wine is suing its former importer in California federal court on claims that it asserted exclusive rights to the brand and sabotaged new deals after their agreement was terminated, saying the U.S. company breached an arbitration award and caused more than $53 million in damages.
