A North Carolina federal judge Thursday granted tobacco giant R.J. Reynolds' bid to dismiss a proposed class action over unsolicited text messages, citing a recent Supreme Court ruling that said the Telephone Consumer Protection Act's prohibitions on unwanted phone calls do not apply to texts.

Reynolds is looking to duck a proposed class action accusing it of sending unsolicited text messages, saying a North Carolina federal judge should apply recent U.S. Supreme Court precedent on judicial deference to find the Telephone Consumer Protection Act doesn't apply to cellphones or texts.

Cigarette and e-cigarette giant R.J. Reynolds Tobacco Holdings Inc. was accused in North Carolina federal court of violating federal law by texting residential telephone numbers listed on the National Do Not Call Registry.
