SPECIAL MASTER'S REPORT. Proposed Stipulation and Order Modifying March 13, 2015 Consent Order Regarding Structural Changes. Due to a change in the relationship between the Sheet Metal Workers International Association and defendant Local 28 with regard to certain terms in the 2015 Structural Changes Order (SCO) (Dkt 313) that affect the employment, pay and benefits of the Office of Court Compliance Officer, the parties have agreed that Local 28 should be permitted to directly employ and compensate Francoise Jacobsohn, the current OCC Officer, as an employee on the Local 28 payroll. To effectuate that agreement, the proposed stipulation seeks to modify paragraph 2 of the SCO (Dkt. 313 at 3 (para. 2)) to read as follows: The OCC Officer shall be compensated and employed directly by Local 28 of the Sheet Metal Workers International Association. The stipulation notes that the parties are in agreement that the OCC Officer shall exercise her responsibilities independently, notwithstanding the fact that Local 28 is Ms. Jacobsons employer and pays her salary and benefits directly, and that Ms. Jacobsohn shall be independent from supervision, direction and control by Local 28 and its officers and other employees in carrying out her duties under the terms of the Structural Changes Order and Exhibit A thereto, the February 8, 2007 Stipulation and Ordered Action Plan, the Referral Hall Rules Consent Order, and such other orders that in any way relate to or affect her position, duties and responsibilities as the OCC Officer.
