MINUTE entry before the Honorable Heather K. McShain: Telephonic status hearing held on 12/05/2022. As discussed on the record, defendant received plaintiff's personnel file from ManpowerGroup US, Inc., and the parties confirmed that there is no dispute that plaintiff's personnel file contained a signed arbitration agreement and that defendant is a third-party beneficiary of that agreement. The parties jointly moved to stay discovery pending arbitration. Under the Federal Arbitration Act, a court must stay proceedings on issues subject to arbitration once the court is satisfied that an enforceable agreement to arbitrate exists that covers the dispute at hand. Here, both parties agree that there is an enforceable arbitration agreement that governs the issues in this dispute. 9 U.S.C. §§ 34; see Zurich American Ins. Co. v. Watts Industries, Inc., 466 F.3d 577, 580-81 (7th Cir. 2006); Tinder v. Pinkerton Sec., 305 F.3d 728, 733 (7th Cir. 2002). Accordingly, the parties' joint motion to stay discovery pending arbitration is granted. By 01/06/2023, the parties are to file a joint status report reporting on the status of the arbitration proceedings and settlement discussions, to include whether the parties seek to schedule a settlement conference with this Court.
