Minute
MINUTE entry before the Honorable Manish S. Shah: No appearance on 5/7/24 is necessary. The motion to quash and for sanctions 167 is denied. Mr. Henry does not have a stake or interest in the PayPal records of other customers and if PayPal believes the subpoena is overbroad or burdensome, it can assert those objections. PayPal can also negotiate the scope of the subpoena with plaintiff's counsel. Nothing in Henry's motion suggests that the subpoena is inappropriately invasive of Henry's privacy. The subpoena calls for routine business records belonging to PayPal and can be treated confidentially during discovery under the terms of the existing protective order. Plaintiff is only seeking records from July to October 2022, a limited request. The subpoena is not unduly burdensome or expensive to comply with for PayPal, so does not violate Rule 45. Notices Mailed. (psm, ) (Entered: 05/07/2024)
