Order on Motion for Default Judgment Order On Motion to Alter Judgment Order on Motion to Vacate
Judge Richard G. Stearns: ELECTRONIC ORDER entered granting in part 55 Motion for Default Judgment as to defendants Daniell N. Liggins a/k/a Danielle Liggins, and Victor O. Edeh, but denying without prejudice as to Amen Okundaye. The court finds as moot 56 Motion to Alter Judgment; and 57 Motion to Alter Judgment.
On April 1, 2024, plaintiff, the Commodity Futures Trading Commission (CFTC) requested that the court enter default judgment against defendants Amen M. Okundaye, Daniell N. Liggins a/k/a Danielle Liggins, and Victor O. Edeh. See Dkt # 55. On April 15, 2024, counsel for Amen Okundaye filed a motion to vacate default judgment with an affidavit and exhibits explaining the circumstances resulting in his failure to communicate Okundaye's acceptance of CFTC's settlement offer. Dkt # 57. The court having considered the matter, and noting the CFTC's lack of opposition to the motion, will treat the motion to vacate as an Opposition. Accordingly, the court grants CFTC's motion for default judgment as to defendants Daniell N. Liggins and Victor O. Edeh. However, the motion is DENIED without prejudice as to Amen M. Okundaye.
Having painstakingly reviewed the proposed Order (Dkt #55-3), the court asks the CFTC to resubmit the Order by Friday, May 10, 2024, maintaining intact the current portions regarding Liggins and Edeh, but deleting those parts referencing Amen Okundaye pending a possible settlement.
