MINUTE entry before the Honorable Heather K. McShain: The Court has now issued rulings [482, 494, 496, 498] addressing all of the requests in the parties' motions in limine and Daubert motions [443, 444, 447, 448]. For the reasons stated in the corresponding Orders, the Orders collectively rule as follows: As to plaintiff's non-expert MIL No. 1 and subsequent requests, the Court rules as a matter of law that defendants' fiduciary duties did not attach at the time of the assignment and that the assignment was not void. Plaintiff's non-expert MIL Nos. 2, 3, and 4 are denied. Plaintiff's non-expert MIL Nos. 5 and 6 are granted. Defendants' non-expert MIL Nos. 2, 3, and 5 are granted. Defendants' non-expert MIL Nos. 1 and 4 are denied. Turning to the parties' expert-related motions, defendants' request to bar John Bucheit's Opinions 2, 3, and 4 under Daubert is denied. Defendants' request to bar reference to the motions for summary judgment in the instant case and the outcomes of those motions is granted. Defendants' request to bar Bucheit's Opinion 1 is granted and to bar Opinion 2 is denied. Defendants' motion to exclude Bucheit's Opinions 5 and 6 is granted in part and denied in part. Defendants' motions to bar the jury from hearing evidence relating to backpay and front pay, and to limit Bucheit's opinions and all other evidence relating to backpay from May 2011 through February 2015 and all evidence of front pay, are denied. Defendants' motion to limit the testimony of Mary Robinson is granted in part and denied in part. Defendants' requests to limit Mary Robinson's testimony and bar entirely Dr. Louis Kraus's testimony are denied. Defendants' motion to exclude Kathleen Graham as an expert is denied. Plaintiff's motion to bar and/or limit the testimony of David Rolewick is granted in part and denied in part.
