MINUTE entry before the Honorable M. David Weisman: The Court is confused. The parties' Joint Status Report 39 discusses depositions in May, but fact discovery is scheduled to close on 4/28/24. See ECF # 16 . Further, the parties request entry of a proposed HIPAA order "so that Plaintiff's medical records may be subpoenaed." That seems an odd way to gather relevant information in a personal injury case, given that the injuries suffered by the plaintiff are generally one of two PRIMARY issues involved, the other being the basis for liability. Yet, the parties propose to gather these records with days left in the discovery process. There are other questions as well. Counsel should be prepared to discuss all of the above and have an agreed plan (including firm dates for depositions) ready to present to the Court at the in person status hearing set for 4/25/24 at 9:15 a.m., which will be proceeding.
